These Terms & Conditions ("Terms") govern your access to and use of the websites, hosting, domain, and related services (the "Services") provided by BGS HOST ("BGS HOST", "we", "us", or "our"), a RASCODEX company. By creating an account, purchasing a Service, or otherwise using our platform, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Definitions

• "Account" — the customer account you register with us.
• "Service" — any hosting plan, domain registration, SSL, add-on, or other product we provide.
• "Content" — any data, files, websites, or material you upload, store, or transmit using the Services.

2. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. You are responsible for providing accurate registration details, keeping your password secure, and for all activity that occurs under your Account. Notify us immediately of any unauthorised use.

3. Services & Plans

Service features, resource limits, and specifications are described on the relevant product page. We may upgrade, modify, or discontinue features to improve the platform, and will give reasonable notice of material changes that affect you.

4. Fees, Billing & Renewals

• All fees are payable in advance for the chosen billing cycle and are quoted exclusive of any applicable taxes unless stated otherwise.
• Services renew automatically at the end of each billing cycle at the then-current price unless cancelled before the renewal date.
• Renewal reminders are sent to your registered email; it is your responsibility to keep your contact and payment details current.
• Failure to pay an invoice by its due date may result in suspension and, ultimately, termination of the affected Services.

5. Refunds

All fees — including hosting plans, domain registrations and renewals, SSL certificates, and add-on services — are non-refundable once the service has been provisioned or activated. Please review your order carefully before purchasing. If you experience a billing error, contact us and we will do our best to put it right.

6. Domain Registration

Domain registrations are subject to the policies of ICANN and the relevant domain registry, including the Registration Agreement and dispute-resolution policies. You are responsible for providing accurate registrant information. Domains are registered on your behalf and remain subject to renewal; expired domains may be suspended, deleted, or subject to redemption fees in accordance with registry rules. Domain fees are non-refundable once registered.

7. Acceptable Use Policy

You agree not to use the Services to host, store, transmit, or link to any material or activity that:

• is illegal, infringes intellectual-property or privacy rights, or violates any applicable law;
• involves spam, bulk unsolicited email, phishing, or fraud;
• distributes malware, viruses, or tools intended to harm or gain unauthorised access to systems;
• contains child sexual abuse material, hate speech, or content promoting violence;
• infringes our network security, attempts to breach other accounts, or launches denial-of-service attacks;
• consumes server resources in a way that degrades service for other customers (resource abuse on shared plans).

We reserve the right to investigate suspected violations and to suspend or remove offending Content or Accounts.

8. Suspension & Termination

We may suspend or terminate your Services, with or without notice, if you breach these Terms, fail to pay, or engage in activity that threatens the security or stability of our platform. You may cancel your Services at any time from your dashboard or by contacting support. Upon termination, your right to use the Services ends and your Content may be deleted after a reasonable period.

9. Backups & Data Responsibility

While we may provide automated backups as a courtesy, you are ultimately responsible for maintaining your own backups of your Content. We are not liable for any loss of data, and you should not rely solely on our backups.

10. Service Availability (Uptime)

We target 99.9% network uptime, excluding scheduled maintenance and circumstances beyond our reasonable control (such as force-majeure events, third-party failures, or customer-caused issues). Maintenance windows will be announced in advance where practicable.

11. Intellectual Property

The BGS HOST name, logo, website, and platform are the property of BGS HOST / RASCODEX and are protected by intellectual-property laws. You retain ownership of your own Content; by using the Services you grant us the limited rights necessary to host and deliver it on your behalf.

12. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, BGS HOST and RASCODEX shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill. Our total aggregate liability for any claim relating to the Services shall not exceed the amount you paid us for the affected Service in the three (3) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless BGS HOST, RASCODEX, and our staff from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your Content, or your breach of these Terms.

15. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. The courts of Faisalabad, Pakistan shall have jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have in your country of residence.

16. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
